Public procurement law regulates the procedure for awarding public supply, service and construction contracts and makes it transparent. The completely revised Federal Law on Public Procurement (BöB) has been in force since 1 January 2022. At the cantonal level, the accession procedures to the revised Intercantonal Agreement on Public Procurement (IVöB) are currently in progress. This will contribute significantly to the harmonisation of procurement law at the cantonal and communal level.
The new procurement law has not been completely changed. However, the quality factor will become more important, as will the criteria of sustainability. Against this background, the question arises as to how suitability and award criteria will be defined and weighted in the future. Suppliers must ask themselves what to look out for in the future when participating in tendering procedures in order to preserve their own chances of success.
In practice, it is important for contracting authorities to structure the award procedure in such a way that, on the one hand, the most advantageous offer can be identified and, on the other hand, the award can withstand any possible complaints.
On the side of the providers, it is a matter of maintaining the chance of winning the bid with an appropriate financial means, be it directly or in the complaints procedure.
Both sides face the risk of inefficient and costly procedures. In this context, it is essential to know the main pitfalls of the procurement process and the means to control risk.
